Parents Blame Kaiser for Disastrous Delivery

SAN DIEGO (CN) - Parents claim in a complaint filed in San Diego County Court that their daughter’s skull was fractured and her brain injured as she was born, and that a Kaiser doctor failed to get their informed consent to use a vacuum device to assist in the delivery.

Soad and Ziad Oraha sued Kaiser Foundation Hospital and affiliates; Clinical Innovations, which makes the Kiwi vacuum device; and Dr. Danielle Hammerman, in Superior Court.

The father, Ziad, says in the complaint that he saw the traumatic birth, with nurses “reacting in a manner that indicated there was an emergency” while he “heard his wife screaming.” And he says he saw his newborn daughter, Angelina, “shaking from seizures.”

The Orahas say their daughter will require hospitalization for an “indefinite period,” and that the mother suffered permanent, disabling injuries.

They seek damages for medical negligence, emotional distress, product liability, failure to warn and loss of consortium.
