Kaiser Docs Missed Lymphoma, Man Contends

ROSEVILLE, Calif. (CN) – Kaiser and its doctors missed a man's lymphoma, he claims in Placer County Superior Court.


David Welch sued Kaiser Foundation Health Plan, Inc., Kaiser Foundation Hospitals dba Kaiser Foundation Hospital – Roseville, The Permanente Medical Group, Inc., Rene Orona, M.D. and Jonathan Wardell, M.D. for medical malpractice. His wife Karen Welch also sued for loss of consortium.

“On or about February, 2016, and prior and several visits subsequent thereto, plaintiff David Welch employed defendants, and each of them, to diagnose and treat his medical conditions and to do all things necessary for his care, including, but not limited to surgery, and other medical treatment and care,” the lawsuit states.

“Plaintiff did not discover the negligence of the defendants, nor the cause of his injuries until August 15, 2019 when his cancer was first diagnosed on August 15, 2019 at Marshall Medical Center in Placerville, Calif., as Stage 4 aggressive non-Hodgkins lymphoma and/or high-grade lymphoma,” the suit continues.

Marshall Medical Center is not named as a party to the lawsuit.

David and Karen Welch seek general and special damages and costs of suit. They are represented by Bruce G. Fagel in Beverly Hills.
