Patient Seeks Recovery of $107,000 Never Owed

OAKLAND, Calif. (CN) - A woman seeks return of $107,000 her attorneys erroneously paid Kaiser and others after she settled a wrongful death and product liability suit against Ford, in Alameda County Superior Court.


Maria Del Carmen Tapia sued Kaiser Permanente; Kaiser Foundation Health Plan; Kaiser Foundation Hospitals; Health Care Recoveries; Trover Solutions Inc.; and Health Care Recoveries Inc. for rescission and constructive trust.
Defendants had put a lien against her recovery, but she did not sue Ford regarding her own injuries from the rollover that killed her husband, so none of the settlement was ever owed to them.
